This Privacy Policy describes how Elementics AI Ltd., doing business as Elementics AI ("Elementics," "we," or "us") collects, uses, discloses, and otherwise processes personal data in connection with your access to and use of the Elementics Reactor Platform ("REACTOR") and related services (collectively, the "Services").

The Services include the Reactor Platform, as well as Elementics' websites, applications, software, APIs, documentation, and AI-assisted research tools made available through www.elementics.ai and related domains. The Services are designed to support scientific, technical, and research-oriented workflows across chemistry, materials science, and related domains.

This Privacy Policy explains what categories of personal data we collect, how and why we process such data, how it may be disclosed, and the rights that individuals may have under applicable data protection and privacy laws. This Privacy Policy should be read together with our Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service.

Because the Services are used in scientific and technical research contexts, users may interact with the Services using information that is sensitive, proprietary, or of significant scientific or commercial value. ELEMENTICS' POLICY IS THAT CUSTOMERS RETAIN OWNERSHIP AND CONTROL OVER THEIR SCIENTIFIC AND RESEARCH CONTENT. Elementics improves the Services by analyzing how users interact with and navigate within the platform, rather than by learning from the scientific or technical substance of customer research content.

Organizational and enterprise use

In some cases, you may access the Services on behalf of an organization, institution, or other entity (for example, where your employer or institution has provisioned access under a commercial or enterprise agreement). In such cases, Elementics may process certain personal data as a data processor on behalf of that organization. The processing of such data is governed by the applicable customer agreement and any associated data processing addendum, rather than solely by this Privacy Policy.

1. Personal Data We Collect

We collect the following categories of personal data. The types of personal data we collect depend on how you interact with the Services.

1.1. Personal Data You Provide to Us Directly

We collect personal data that you choose to provide to us when you create an account, subscribe to the Services, communicate with us, or otherwise interact directly with Elementics, including:

Account Information.

Information such as your name, email address, and organizational affiliation, which is used to create and manage your account and provide access to the Services.

Payment and Billing Information.

If you subscribe to paid Services, payment and billing information is collected and processed by Elementics' authorized Merchant of Record on our behalf. Elementics does not directly process or store full payment card or banking details. We may receive limited billing or transaction-related information necessary for account administration, invoicing, and customer support.

Communications.

Information you provide when you contact us, including your name, contact details, and the contents of messages you send to us in connection with support requests, inquiries, or other communications.

Feedback.

Information you voluntarily submit such as comments, suggestions, or feedback regarding the Services. Feedback is provided at your discretion and is not intended to include proprietary scientific or research content unless you choose to provide it.

B. Personal Data We Receive Automatically Through Use of the Services

When you access or use the Services, Elementics automatically collects certain technical and usage-related information generated by your interaction with the platform, including:

Device and Technical Information.

Information about the device, browser, and operating system you use to access the Services, as well as general network information, which helps us ensure compatibility, performance, and security.

Log and Performance Information.

Information such as IP address, timestamps, error logs, and system diagnostics that allow us to operate, monitor, secure, and troubleshoot the Services.

Usage Data.

Information about how users interact with the Services, including feature usage, workflow navigation, interaction patterns, and general engagement with different parts of the platform.

As described in the Terms of Service, Usage Data is non-scientific and non-semantic and does not include or preserve the scientific, technical, or research substance of user content.

Cookies and Similar Technologies.

We use cookies and similar technologies to operate and administer the Services, maintain user sessions, remember preferences, and understand aggregated usage patterns. You can control the use of cookies through your browser settings. Where required by applicable law, we will provide additional information or choices regarding such technologies and obtain your consent before placing non-essential cookies and provide appropriate tools to manage your cookie preferences.

General Location Information.

We may derive general geographic location (such as city or country level) from technical information like IP address for security, fraud prevention, and service reliability purposes. We do not collect precise location data.

C. Information We Do Not Collect

Elementics does not knowingly collect or require the submission of sensitive or special category personal data, including, without limitation, genetic data, biometric data used to uniquely identify a natural person, health or medical information, or information relating to race, religion, or similar protected characteristics.

The Services are designed for use by scientific and technical professionals and are not directed to children. Elementics does not knowingly collect personal data from individuals under the age of eighteen (18). If we become aware or have reason to believe that a user is under the age of 18, we will take appropriate steps to investigate and, where required, delete the associated personal data and/or deactivate the account.

Elementics also does not seek to collect personal data as part of scientific or research workflows and does not require users to submit personal data in order to use the core research functionality of the Services.

2. How We Use Personal Data

Elementics uses personal data only as necessary to operate, secure, and improve the Services, in accordance with our Terms of Service. Depending on how you use the Services, personal data may be used for the following purposes:

    Enable access to the Reactor Platform, deliver core functionality, maintain system performance and reliability, and support scientific and technical workflows.

    Create and administer user accounts, facilitate subscriptions and billing through our authorized Merchant of Record, respond to inquiries, and provide customer support.

    To maintain safety, security, and integrity.
    Prevent, detect, and investigate fraud, abuse, security incidents, and violations of our Terms of Service, and protect the rights, safety, and property of Elementics, our users, and third parties.

    To improve and develop the Services.
    Analyze operational telemetry and Usage Data to understand how the Services are used, debug and resolve issues, improve performance and reliability, and refine workflow design and usability.

    Usage Data is non-scientific and non-semantic and does not include or preserve the scientific, technical, or research substance of customer content.

    Send service-related communications such as account notices, security updates, billing or support messages, and service updates. Where permitted by law, we may also send informational or promotional communications, which you may opt out of at any time.

    To comply with legal obligations and enforce agreements.
    Comply with applicable laws and lawful requests, resolve disputes, and enforce our Terms of Service and other applicable agreements.

ELEMENTICS DOES NOT USE CUSTOMER RESEARCH CONTENT OR OUTPUTS GENERATED BY PAID USERS TO TRAIN, FINE-TUNE, OR IMPROVE ITS MACHINE LEARNING OR AI MODELS, AND DOES NOT PERMIT THIRD PARTIES TO DO SO.

Customer Research Content and Outputs may be reviewed or processed where necessary to operate the Services, address security or misuse, respond to user-initiated feedback, or comply with legal obligations, and any use of such content for training or service improvement is governed by the Terms of Service.

If you use a free or freemium version of the Services, Elementics may use Customer Research Content and Outputs to operate and improve the Services, including for model training, as described in the Terms of Service. Data-use restrictions applicable to paid plans apply only on a forward-looking basis, as further set out in the Terms of Service.

Elementics may aggregate or de-identify Usage Data and operational telemetry so that it no longer identifies you, and use such information for the purposes described above. We do not attempt to re-identify de-identified information except where required by law.

Legal Bases for Processing (EEA/UK)

Where required by applicable law, including for users in the EEA and the UK, Elementics processes personal data based on one or more of the following legal bases: performance of a contract; legitimate interests (such as operating, securing, and improving the Services); compliance with legal obligations; and consent, where required. Consent may be withdrawn at any time.

3. How We Share Personal Data

Elementics may disclose personal data in the following limited circumstances, and only as necessary for the purposes described in this Privacy Policy:

Service Providers and Subprocessors.

We may share personal data with trusted third-party service providers and subprocessors that support our operations and help us deliver, operate, and secure the Services. This includes providers of cloud infrastructure, hosting, analytics, communications, customer support, security, compliance, and IT services.

These providers process personal data only on our behalf, in accordance with our instructions, applicable law, and contractual confidentiality and data protection obligations.

Payment Processing.

Payments for paid Services are processed by our authorized Merchant of Record and related payment service providers. Personal data shared for billing and payment purposes is handled in accordance with the Merchant of Record's applicable terms and privacy policies.

Business or Organizational Accounts.

If you access the Services through an account provisioned by an organization (such as an employer or institution), certain account-related information (for example, your name, email address, and account status) may be disclosed to that organization's authorized administrators for account management, security, and compliance purposes.

Legal Compliance and Protection of Rights.

We may disclose personal data where we believe disclosure is necessary to comply with applicable laws, regulations, legal processes, or lawful requests; to investigate or prevent fraud, security incidents, or misuse; to enforce our Terms of Service or other agreements; or to protect the rights, safety, or property of Elementics, our users, or third parties.

Business Transfers.

In the event of a merger, acquisition, reorganization, sale of assets, bankruptcy, or similar corporate transaction, personal data may be disclosed to advisors or counterparties as part of due diligence and transferred as part of the transaction, subject to applicable data protection laws.

With Your Direction or Consent.

We may disclose personal data where you choose to share it with third parties through the Services or otherwise direct or consent to such disclosure.

4. Retention

Elementics retains personal data only for as long as reasonably necessary to provide and operate the Services, comply with applicable legal obligations, maintain security, resolve disputes, and enforce our agreements.

Retention periods vary depending on the nature and purpose of the data, the context in which it was collected, its sensitivity, and applicable legal or regulatory requirements. Some data may be retained for shorter periods where it is used for operational, security, or system monitoring purposes, while other data may be retained longer where required for legal, accounting, or compliance reasons.

When personal data is no longer needed for these purposes, Elementics will take reasonable steps to delete, erase, de-identify, or anonymize such data in accordance with applicable law and our internal data retention practices.

5. Security

Elementics implements commercially reasonable technical and organizational measures designed to protect personal data against accidental or unlawful destruction, loss, misuse, and unauthorized access, disclosure, or alteration.

Despite these measures, no method of transmission over the Internet or method of electronic storage is completely secure. You should exercise discretion when deciding what information to share through the Services.

Elementics is not responsible for the security practices of third-party websites, services, or integrations that may be linked to or accessed through the Services, nor for any circumvention of security features beyond our reasonable control.

6. Your Rights and Choices

Depending on where you live and the laws that apply to you, you may have certain rights with respect to your personal data. These rights may include the right to access, correct, delete, or receive a copy of your personal data; to object to or restrict certain processing; or to withdraw consent where processing is based on consent. You may also have the right to lodge a complaint with your local data protection authority.

Where permitted by law, Elementics will not discriminate against you for exercising your privacy rights.

Right to know.

The right to know what categories of personal data we collect, the purposes for which we use it, and the types of third parties with whom it is shared.

Access and portability.

The right to request access to the personal data we hold about you and, where applicable, to receive it in a structured, commonly used, and machine-readable format.

Deletion.

The right to request deletion of personal data collected about you, subject to applicable legal exceptions (such as compliance with legal obligations, security, or dispute resolution).

Correction.

The right to request correction of inaccurate personal data we maintain about you.

Objection and restriction.

The right to object to or request restriction of certain processing of your personal data, where permitted by law.

Withdrawal of consent.

Where our processing is based on your consent, the right to withdraw that consent at any time. Withdrawal does not affect the lawfulness of processing prior to withdrawal.

No automated decision-making.

Elementics does not make decisions based solely on automated processing that produce legal or similarly significant effects on individuals.

No sale or targeted advertising.

Elementics does not sell personal data, does not share personal data for cross-contextual behavioral advertising, and does not process personal data for targeted advertising purposes as those terms are defined under applicable U.S. state privacy laws. We also do not process sensitive personal data for the purpose of inferring characteristics about individuals.

Elementics processes personal data on servers located in multiple jurisdictions, including outside your country of residence. Where personal data is transferred internationally, we take steps to ensure that such transfers are made in accordance with applicable data protection laws and appropriate safeguards, such as legally valid transfer mechanisms.

For users in the European Economic Area (EEA), the United Kingdom, or Switzerland, this may include transfers to countries that do not provide the same level of data protection as your home jurisdiction. In such cases, Elementics relies on appropriate safeguards to protect your personal data.

7. Jurisdiction-Specific Disclosures

Certain jurisdictions require additional or more specific disclosures regarding how personal data is collected, used, and retained.

This Privacy Policy is intended to provide a general description of Elementics' data practices. Where required by applicable law, additional jurisdiction-specific information or disclosures may apply and will supplement this Privacy Policy. Elementics complies with the Israeli Privacy Protection Law, 1981, and applicable regulations, including requirements relating to the protection and security of personal data stored in databases.

8. Changes to This Privacy Policy

Elementics may revise this Privacy Policy from time to time to reflect changes in our practices, legal requirements, or the Services. When we do, we will post the updated Privacy Policy on this page and update the "Last Updated" date.

Where required by applicable law, we will provide additional notice of material changes. Your continued use of the Services after an updated Privacy Policy becomes effective constitutes your acknowledgment of the updated Privacy Policy.
